Those who still use ID cards should do so immediately before December 31 to avoid fines

This is one of the regulations that ID card users must pay special attention to from 2025. Accordingly, in the transitional regulations in Article 46 of the Law on Identification 2023, ID cards with an expiry date can only be used until December 31, 2023. 2024.

That means, from January 1, 2025, all ID cards, including 9 or 12 numbers, will be canceled. Those who are using ID cards – whether they are still valid or expired – can no longer be used when carrying out administrative procedures.

Failure to update new identification documents can also result in people being fined. Therefore, those who are using ID cards need to immediately complete the procedure to change to an ID card before December 31, 2024 to avoid problems related to identification documents in the near future.

Note: Although ID cards will no longer be valid from 2025, legally valid documents issued using information from ID cards will still retain their value; State agencies are not allowed to request citizens to change or adjust ID card information in issued documents.

In 2025, what is the penalty for intentionally using an old ID card?

From January 1, 2025, the old ID card will no longer be valid. Therefore, if you still intentionally use the old ID card when performing transactions and administrative procedures, the user may be subject to administrative fines for failing to comply with the law on issuance, exchange, and re-issuance of cards. Citizen identification card.

Specifically, Point b, Clause 1, Article 10 of Decree 144/2021/ND-CP stipulates penalties for violating regulations on issuance, management, and use of ID cards, ID cards or Citizen Identification cards as follows:

1. Caution or fine from 300,000 VND to 500,000 VND for one of the following acts:

a) Failure to present ID card, ID card, citizen identification card or ID card number confirmation when requested for inspection by a competent person;

b) Failure to comply with legal regulations on issuance, exchange, and re-issuance of Citizen Identification cards;

c) Failure to return the ID card, ID card or Citizen Identification card to the competent authority when relinquished, stripped of nationality, or canceled the decision to naturalize in Vietnam; Failure to return the ID card, ID card or Citizen Identification card to the agency executing the custody or detention order, the agency executing the prison sentence, or the agency executing the decision to send to a reformatory. , compulsory education establishments, compulsory drug treatment establishments.

If you are using CCCD, do you have to change to an Identification card?

Unlike ID cards, which can only be used until December 31, 2024, CCCD cards, whether barcoded or chip-embedded, can still be used normally in 2025 if the expiration date on the card is still valid.

In particular, CCCD cards will only be changed to Identification cards if people need to change and make a request to change the card according to the provisions of Clause 1, Article 46 of the Law on Identification 2023.

Note: Along with the new regulations from 2025 for users of ID cards and CCCDs mentioned above, the management agency does not stipulate separate procedures for changing and adjusting documents with information about ID card numbers and CCCD numbers. Procedures for changing ID card to ID card

Currently, citizens in need can do so online on the Public Service Portal or directly at the place where they carry out procedures for issuance of Identification cards. Currently, citizens will usually choose the district police to carry out the task.

Article 23 of the Law on Identification 2023 stipulates the procedures for issuance of Identification cards as follows:

In case of issuing ID cards to people 14 years of age or older

Step 1: Go to the agency to carry out procedures for issuance, replacement, and re-issuance of Identification cards

Step 2: Provide personal information

The recipient checks and compares information of the person needing an ID card from the national population database, national database, and specialized database to accurately determine the person needing the card. Identity.

In case there is no information about the person needing an Identification card in the National Population Database, procedures for updating and adjusting information must be carried out in the National Population Database.

Step 3: Acquire identification and biometric information

The recipient receives identification information and biometric information including facial photos, fingerprints, and iris of the person needing an Identification card.

Step 4: The person needing to issue an ID card checks and signs the ID information receipt form

Step 5: Issue an appointment letter to return the Identification card;

Citizens will have their ID cards returned to the location stated in the appointment letter.

In case the person needing an ID card requests to return the ID card at another location, the ID card management agency will return the ID card at the requested location and that person must pay the delivery service fee.

In case of issuing ID cards to people from 06 – under 14 years old

People from 6 years old to under 14 years old and their legal representative come to the identification management agency to receive identification information and biometric information.

The legal representative of a person from 6 years old to under 14 years old shall carry out the procedures for issuing an ID card on behalf of that person. Procedures for issuing an ID card are similar to those for people 14 years of age or older.

In case of issuing ID cards to people under 6 years old

The representative carries out procedures for issuing ID cards to people under 06 years old through the public service portal or VNeID application. In case a person under 06 years old has not registered their birth, the legal representative will carry out the procedures for issuing an Identification card through procedures linked to birth registration on the public service portal, VNeID application or directly at Identity management agency.

The Identification Authority does not collect identification and biometric information for people under 6 years of age.

The legal representative of a person under 14 years old must have papers and documents proving that he or she is the legal representative of a person under 14 years old (according to instructions in Clause 1, Article 21 of Decree 70/2024/ND-CP).
